PT.Guntung Idaman Nusa (PT. GIN) dan Kantor Pertanahan kabupaten indragiri hilir. “Melalui Kuasa Hukumnya Dr. Tiar Ramon SH., MH, masyarakat Desa Lahang Hulu Kecamatan Gaung Kabupaten Indragiri Hilir Riau Indonesia menggugat PT Guntung Idaman Nusa/PT. GIN sebagai Tergugat I terkait dengan penguasaan lahan dan Kantor Pertanahan Kabupaten Indragiri Hilir Riau,
Sebagai Tergugat II terkait dengan penerbitan sertipikat HGU ke Pengadilan Negeri Tembilahan terdaftar perkara No.02/Pdt.G/2019/PN.TBH.
Inti dasar/alasan gugatannya adalah lahan tersebut milik masyarakat (Para Penggugat) sebagai penggarap atau mengusahakannya sejak tahun 1976 (bukti surat asli 1976 masih ada) sementara seluruh lahan tersebut berada di areal Sertipikat HGU No, 28 Tahun 2015 milik PT Guntung Idaman Nusa /PT. GIN (Tergugat I) yang datang tahun 2007, dan belum dilakukan pembebasan/pelepasan tanah/lahan dengan ganti rugi sebagaimana diatur dalam Peraturan Pemerintah No. 40 Tahun 1996, sehingga Sertifikat HGU tersebut oleh Para Penggugat dianggap tidak sah karena mengandung cacat hukum dalam prosedur penerbitannya dan harus dibatalkan.
Adapun jumlah luas lahan yang bersengketa adalah 1.343.75 Hektar. Akibat penguasaan PT GIN (Tergugat I) tersebut masyarakarat (Para Penggugat) mengalami kerugian materil sebesar Rp. 20.156.250.000,- (Dua Puluh Milyar Seratus Lima Puluh Enam Juta Dua Ratus Lima Puluh Ribu Rupiah) dengan perincian 1 hektar Rp. 15.000.000 X 1.343.75 hektar. Sekarang perkara ini masih dalam proses hukum di Pengadilan Tinggi Banding Pekanbaru Riau.
Perkara ini dimungkinkan terus akan berlanjut sampai tingkat Kasasi Mahkamah Agung. Karena nampaknya masyarakat terus berjuang menuntut keadilan. Ucap Ramon selaku kuasa hukum
Ia menambahkan bahwa Kami berkeyakinan kebenaran akan berpihak kepada masyarakat. Buktinya putusan Pengadilan Negeri Tembilahan, dulu pernah saya ajukan Kasasi dan dibatalkan oleh Mahkamah Agung.
Menurur Tiar Ramon sebaiknya sengketa dengan masyarakat tersebut harus diselesaikan, Penyelesaiannya sebaiknya tidak melalui jalur pengadilan. Kesannya akan ada menang atau kalah. Satu sisi ada yang puas satu sisi lagi ada tidak puas atau kecewa. Secara hukum mungkin sudah selesai karena inkracht (berkekuatan hukum tetap) namun belum tentu kenyataan di lapangan selesai. Pungkasnya
Bisa saja masih bersengketa sampai ke anak cucu, sehingga perusahaan tidak aman dan tenang menjalankan usahanya tersebut dan bisa menimbulkan ketidakpercayaan rekan bisnisnya baik nasional maupun internasional. Maka sebaiknya diselesaikan dengan damai. Sayangnya perkara yang masih dalam proses hukum ini perusahaan enggan melakukan perdamaian walaupun masyarakat sudah menawarkan perdamaian di mediasi. Sedikitpun perusahaan tidak membuat penawaran perdamaian.
Seharusnya beroperasinya perusahaan tersebut dapat meningkatkan kesejahteraan dan kemakmuran masyarakat tempatan atau lokal. Jangan justru sebaliknya terjadi sengketa yang menimbulkan kerugian dan kemiskinan, sebut ramon.
