Pengacara Tutik Rahayu berpendapat seorang wartawan didalam pemberitaan tidak bisa dilakukan pemanggilan sebagai saksi.
“Seorang wartawan dalam pemberitaan ketika ada temuan dan ada narasumber tentunya Tidak bisa serta merta dilakukan pemanggilan untuk memberikan keterangan sebagai saksi terlebih ada hak jawab,” Jelasnya.
Sesuai dalam pasal 5 UU No. 40 Tahun 1999 tentang Pers diatur sebagaimana ‘Pers nasional berkewajiban memberikan peristiwa dan opini dengan menghormati norma-norma agama dan rasa kesusilaan masyarakat serta asas praduga tak bersalah’.
Serta BAB 11 menjelaskan Asas, Fungsi, Hak, Kewajiban, dan Peranan PERS sesuai pasal 2, pasal 3, pasal 4, pasal 5, pasal 6 sudah sangat jelas dan tidak perlu harus ditafsirkn.
Ketika dari pihak penyidik masih memanggil dan ada rasa memaksakan tentunya ini menjadi pertanyaan,Selasa (19/03/24).
Tutik Rahayu, S.H mengingatkan, agar penyidik di POLRI untuk menghormati Hak Tolak para jurnalis agar tetap dapat bekerja secara independen dan imparsial, tanpa perlu merugikan narasumber.
“Di dalam UU Pers sudah dijelaskan sebagaimana mestinya pada pasal 4 ayat (4) yang mengatakan Hak Tolak diberikan wartawan untuk melindungi sumber informasi,” Tegasnya.
Hak Tolak mungkin adalah sesuatu yang dirancang didalam UU Pers agar wartawan tidak diperalat untuk menjerat seseorang.
“Diharapkan Pejabat penyidik maupun polisi tidak boleh meminta keterangan, selain hal-hal yang sudah disiarkan,” Tambahnya.
Jika jurnalis memberikan keterangan yang dapat digunakan untuk menjerat narasumber, maka hal ini akan merusak kepercayaan narsumber terhadap jurnalis.
Agar kehadiran jurnalis tetap dapat diterima oleh siapapun, maka jurnalis tidak boleh memberi keterangan untuk menjerat pihak-pihak lain,” Tutup Tutik.
