Provinsi Banten, selidikkasus.com – Seorang mantan Pejabat BUMN pada periode 1983-2001 berinisial SA, dan 8 (delapan) orang anggota keluarganya, usai bulan ramadhan ini bakal diperiksa intensif oleh aparat penegak hukum terkait kepemilikan harta, dengan rekening gendut dengan nominal senilai Rp. 5 triliun. Harta itu diduga diperoleh dari hasil korupsi, manipulasi pajak selama SA menjabat di salah satu perusahaan plat merah.
SA, dan delapan keluarganya akan dipersangkakan melanggar UU No. 3 Tahun 1971 tentang Pemberantasan Tindak Pidana Korupsi jo UU No. 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi Jo UU N0. 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi, Dan Atau UU No. 8 Tahun 2010 tentang Tindak Pidana Pencucian Uang (TPPU) jo Pasal 55 Ayat (1) Ke-1 KUHP.
“SA melakukan tindak pidana pencucian uang, dengan modus Legitimate Business Conversions, menyamarkan hasil dari predicate offence, agar tidak diketahui asal usulnya, merubah performance, atau asal usul hasil kejahatan untuk tujuan selanjutnya dan menghilangkan hubungan langsung dengan tindak pidana asalnya.
Temuan kasus korupsi, manipulasi pajak dan TPPU yang menarik ini, akan kita laporkan resmi ke lembaga penegak setelah lebaran nanti. Penyidikannya diusulkan dalam bentuk joint investigation, dengan Dirjen Pajak.
Satgas Building, dan TPPU KPK harus mensupervisi, mengingat nilainya yang fantastis Rp. 5 triliun,” Koordinator Satgas Anti Diskriminasi Hukum (SADIS) H. Gunawan kepada wartawan selidik kasus.com di Banten, pada (09/05/2020).
Gunawan membeberkan berdasarkan penelusuran SADIS, sejak tahun 1985 hingga 2017, dari hasil Asset Tracing, terungkap SA membelanjakan uang kini nilainya Rp. 2,7 Triliun, diduga hasil pidana korupsi, dan manipulasi pajak, untuk dibelikan 308 bidang tanah yang tersebar di Jalan TB Simatupang, Kemang Bangka, Jalan Kapten Piere Tandean, Gandul Cinere, Pondok Cabe, Pakuon Cianjur, Margonda Raya, Ciputat, Apartemen di Marina Bay, Singapore, Brawijaya Apartement, dan Apartement Ednah Street, Como, Australia yang dibeli Juni 1993. Sebagai “Gatekeeper” diatasnamakan 8 (delapan) anggota keluarganya.
Dan diketahui pula, pada saat menjabat menjadi petinggi BUMN, SA memiliki deposito di Banquete Nationale De Paris (BNP) sebesar USD 101 ribu dan GBP 657 ribu, No. Rek. 504-05790-XX, di Citigold, Priority Banking Singapore USD 2,2 juta, No. Rek: 2944XX, di Bank Citibank (Citione) USD 800 ribu No. rek: 115-00129X-X di LIPPOBANK Warung Buncit, Jakarta USD 320 ribu,-, di PT. Bank Mandiri Cabang Jakarta Patra Jasa USD 528 ribu, dan Rp. 3 milyar, di PT. BPR Rp. 5.5 milyar, dan USD 40,2 ribu di Chase Manhattan Bank. Memperoleh kredit sebesar USD 1,753 juta di Credit Suisse dan Re: A/C 246X, USD 2,38 juta di Credit Suisse First Boston.
Kemudian, Harta berikutnya berupa saham-saham yang tersebar di berbagai perusahaan, termasuk saham di PT. Bank M, dan Bank D.
Menurutnya ada modus operandi “pengamanan” yang menarik dalam kasus ini.
Meskipun statusnya keluarga sendiri, SA tetap tidak percaya.
SA mewajibkan para “Gatekeeper” menandatangani Pengikatan Jual Beli Lunas, sesuai bukti Akte Pengikatan Jual Beli tanggal 21-08-1985, no: 57, 67, 65, 62, 58, 59,63, 66, 64, 60, 68, dan 69, yang diterbitkan Kantor Notaris Ny. Y.T, SH.MH. Dan dengan pola ini, SA dapat mengamankan harta yang dititipkan kepada para “Gatekeeper” dari kemungkinan terjadinya penghianatan.
Sesuai bukti SPT tahun 2014-2015-2016-2017-2018, SA yang memiliki kekayaan Rp. 5 triliun itu, hanya melaporkannya Rp. 400 milyar.
Sehingga selain korupsi, SA dapat dijerat pula melanggar ketentuan Pasal 18 UU, No 11, Tahun 2016 tentang Pengampunan Pajak. Dapat dikenakan sanksi administrasi perpajakan sebesar 200% (dua ratus persen) dari Pajak Penghasilan yang tidak atau kurang dibayar, sehingga SA wajib membayar pajak berikut denda kepada Negara dengan nominal sebesar Rp. 3,08 Triliun. Pihak Dirjen Pajak dapat langsung menerapkan sandera badan (gijzeling) terhadap SA di LP Salemba, DKI Jakarta.
Tidak Kedaluwarsa, dan Memiliki Lebih dari Dua Alat Bukti cukup.
Gunawan menegaskan berdasarkan 3 (tiga) alat bukti petunjuk yang saling berkesesuaian, berupa asli tulisan tangan SA, yang dibuat pada tahun 1986-1987-1988, terbukti aktif memberikan perintah penempatan-penempatan uang yang diduga hasil korupsi dan manipulasi pajak.
Termasuk berupa surat wasiat yang ditujukan kepada anak-anaknya mengenai keberadaan uang yang didepositokan di BNP, Chase Manhattan, City Bank of Jakarta.
“Jika terjadi sesuatu pada saya maka uang-uang itu adalah milik AMH, bersama-sama adik-adiknya, dengan pengaturan penggunaannya oleh adik saya S,” tulis SA dengan membubuhkan tandatangannya.
Gunawan menjelaskan, sesuai United Nations Convention Againts Corruption 2003 Article 29, yang telah disahkan berdasarkan UU No 7 Tahun 2006 tentang Pengesahan United Nations Convention Againts Corruption 2003, Pasal 78 ayat (1) butir ke-2 KUHPidana dapat disimpangi (judge made law). Hukum Tipikor tunduk pada aturan di KUHP tentang apa yang tidak diatur secara tersendiri di UU Tipikor.
Adanya, ketentuan khusus/spesialis tunduk pada aturan yang lebih umum, ketika ketentuan khusus tidak mengatur yang lain, atau sebaliknya. Berdasarkan judge made law oleh kalangan hakim pengadilan telah dibentuk norma kaedah hukum yurisprudensi, bahwa Tipikor merupakan kejahatan luar biasa, sehingga perihal kaedah kadaluarsa tidak diberlakuan dalam konteks pelaku, dan perilaku terkait Tipikor.
“Pelaku korupsi seperti SA, berkeahlian menyembunyikan perilaku korupsinya, sehingga pemberlakuan daluarsa tuntutan perkara korupsi dihitung sejak diketahui perbuatan korupsinya,” ujarnya.
Gunawan mengklaim memiliki bukti lengkap, otentik, dan valid sebanyak 29 (dua puluh sembilan) dokumen. Antara lain asli dokumen kepemilikan dana di Banque Nationale De Paris (BNP), CitiOne, CITIBANK, Singapore, CitiGold, Priority Banking, Citi-One Deposit Instructions, Deposit Slip BNP Singapore, foto copy 308 (tiga ratus delapan) SHM berikut warkahnya, atas nama SA dan keluarganya.
Dan masih banyak lagi yang kini masih dalam penguasaan saksi A.R, karib SA sejak tahun 1972. Mudah-mudahan A.R bersedia kooperatif. Saat ini sudah ada lebih dua alat bukti untuk menetapkan para pelaku sebagai tersangka.
Saya akan meminta agar kasus ini segera diusut tuntas, dan seluruh harta SA sebesar nominal Rp. 5 triliun disita untuk kepentingan negara. SA memiliki typical crimes yang sangat kejam, dan tamak. Namun, dalam hal ini tidak hanya uang Negara yang disikat. Harta milik orang lainpun ada yang digelapkan.
Ilusrtasi sebagai contoh, seorang janda tua di Tangerang, baru dikasih uang muka Rp. 25 juta, tanahnya raib digelapkan SA.
Lalu dengan akte jual beli yang direkayasa SA menjual tanah tersebut sebesar Rp. 29 milyar. pada tahun 2008, SA pernah divonis 6 bulan penjara oleh majelis hakim Jakarta Selatan dalam kasus penipuan dan penggelapan. SA kini berstatus sebagai tersangka menggelapkan sawah milik orang lain di Cianjur Selatan, Jawa Barat, seluas 4,9 hektare.
Berikutnya, ada 3 Laporan Polisi lagi yang kini tengah diproses di Jakarta, dengan kerugian nominal Rp 400 milyar, atas pengaduan seorang pemilik tanah yang digelapkan SA. Satu LP sudah naik ke tahap penyidikan,” ujarnya Gunawan yang merupakan tokoh yang telah melaporkan kasus manipulasi pajak Bambang Widjojanto, mantan wakil KPK pada periode Abraham Samad kala itu.
