Pekanbaru-Riau- “ini Hasil Putusan Banding DKP-PERADI: Muslim Amir Dinyatakan Bersalah dan Denda Rp 20 juta

Majelis Hakim Dewan Kehormatan Pusat- Perhimpunan Advokat Indonesia (DKP-PERADI) memonnis Muslim Amir, SH., seorang Advokat, bersalah melanggar kode etik.

Sebelumnya, Majelis Hakim Dewan Kehormatan Daerah (DKD) PERADI Pekanbaru, menghukum Muslim Amir dengan pemberhentian selama setah un.

Muslim Amir diadili berdasarkan pengaduan teman sejawat ( sesama Advokat) yakni DR Yudi Krismen atas dugaan perampasan klien Yudi Krismen, yakni kelurga pasien meninggal dunia akibat korban malpraktek di Rumah Sakit Aulia Pekanbaru.akhir tahun silam.

Muslim Amir, kemudian merampas hak-hak Yudi Krismen selaku Pengacara keluarga korban, dengan kedok sebagai Pengacara Cirporate di rumah sakit tersebut.

Tidak senang dengan tindakan tidak beretika itu, Yudi Krismen kemudian melaporkan masalah ini ke DKD PERADI Pekanbaru.

Setelah proses persidangan yang alot di DKD, Muslim Amir divonnis bersalah dan diberhentikan dari profesinya selama setahun. Muslim Amir kemudian mengajukan banding.

Di tingkat DKP ternyata Muslim Amir tetap dinyatakan bersalah. Dia dinyatakan melamggar dua pasal Kode Etik Advokat Indonesia.

Lantas, sebagai Pembanding Muslim Amir harus menerima hukuman: teguran tertulis serta membayar denda di tingkat Dewan Kehormatan Daerah (DKD-PERADI) Pekanbaru dan denda di Tingkat DKP-PERADI, masing-masing Rp 10 juta.

Dalam amar putusannya tanggal 3 Maret 2020, yang salinannya diterima Terbanding, DR Yudi Krismen, SH.,MH kenaren (18/3) dijelaskan, Majelis DKP menerima sebagian upaya banding Muslim Amir.

“Tetapi, intinya DKP menyatakan Muslim Amir bersalah melanggar Pasal 3 Huruf d serta Pasal 5 Huruf a Kode Etiak Advokat Indonesia. Malah dia menerima hukuman denda Rp 20 juta,” kata Yudi Krismen.

Sebagai Pengadu dan Terbanding, Yudi Krismen tampaknya masih melanjutkan perjuangannya.

“Dalam wakru dekat, saya akan menggugat secara Perdata: Muslim Amir, Dokter yang melakukan malpraktek dan pihak Rumah Sakit Aulia,” kata Yudi Krismen saat memberi keterangan pers di Kantornya (18/3)(is/s/tim)
