Selain itu, apabila ada saksi yang melihat terjadinya penyiksaan, biasanya sesama tersangka/terdakwa atau penghuni tempat penahanan, mereka enggan bersaksi karena khawatir dengan kemungkinan adanya balas dendam atau dampak lain yang diterima selama mereka menghuni tempat penahanan.
Kondisi ini jelas menempatkan para korban penyiksaan pada situasi yang sulit untuk memperoleh keadilan atas penderitaan yang mereka alami.
